Car Accident Basics and Your Responsibilities

Read more Car Accident articles: http://j.mp/29Nvdma

Despite everyone’s best intentions and best efforts, accidents can and do still happen. When a car accident happens, we need to be prepared for the situation. There are basic things to know to do and to avoid doing so that missteps lead to further problems.

5,000,000+ car accident per year in the USA

In the USA, there are over five million car accidents per year. Of these, over 35,000 result in fatalities. There are on average 80 traffic fatalities per day in the USA. Given these statistics, it is a good idea for drivers and pedestrians to be familiar with common car accident procedures.

There are at least five types of car accidents

There are five most common car accident types. These are rear-end collision, side-impact, hydroplaning, hitting a parked car, and striking an animal. The first three types are “in-traffic” and involve two or more vehicles. Traffic accidents could involve many vehicles.

Defensive driving required to avoid accidents

Avoiding an accident is better than correcting a situation. There are several ways to help people avoid accidents. Drivers should use caution. You may want to consider a defensive driving course. Defensive driving courses are offered in many places. Some localities even offer insurance discounts for drivers who have taken the course.

Keep both hands on the wheel

When driving, do not talk on the phone, eat, or apply make-up. Drivers should keep both hands on the wheel at all times. Your hands should be at the 10 o’clock and 2 o’clock positions. This gives you maximum flexibility and control to turn the wheel in either direction. Do not cross your hands when you are turning the wheel.

Vision and Visibility should be perfect

Keep your eyes moving and checking mirrors and windows. Do not get stuck fixating on one point. Keep looking for developing hazards in many directions. Make yourself visible by using headlights and turn-signals. Contrary to popular belief, headlights are meant to make you visible to others as much as helping you to see. Be careful of being in another driver’s blind spots. Safely move to another position to make sure drivers around you can see you.

Speed and distance should be maintained with prudence

Match your speed to the traffic flow around you as well as weather conditions. Drive neither too fast nor too slow. Keep a two-second distance minimum between yourself and the car in front of you. At intersections, make sure your way is clear to both enter and exit the intersection before proceeding into it.

Wear seat belts for safety

Drivers and passengers should wear seat belts. In fact, many places have laws that are strictly enforced on this issue. Children should be in safety-approved car seats if they are too small for the standard seat belt. Having children belted-in is as much for their safety as well as avoiding distracting the driver, if the child wanders loose around the inside of the vehicle.

Steps to be taken in case of an accident

If you are involved in an accident, check everyone involved for injuries. Call emergency help if needed. Contact the police and your insurance company from the scene of the accident. Exchange information with the other drivers and witnesses. Make a note of the vehicles and license plate numbers. Make sure your insurance coverage information is in the vehicle so that it is easy to refer to. Be careful of what you say and do not admit fault.

Keep the documents of evidences and reports

Be sure to get copies of the police report. Check it carefully for any mistakes. Inform the police, your insurance company, and your lawyer of any mistakes or discrepancies. By following these steps, you can avoid an accident as much as possible. Then, if an accident happens, you can manage and navigate the situation successfully.

Why You Need an Attorney for Your Car Accident

Read more Car Accident articles: http://j.mp/29Nvdma

We have all heard many jokes about lawyers, especially lawyers involving injury cases. People often deride the overly litigious nature of our society. However, when you are faced with the aftermath of an accident, you may find that an attorney is your best ally. Here are some things to consider in deciding if you need an attorney.

Lawyers are experienced in litigation and claims

Lawyers are experienced in litigation and claims handling. They will be able to advise you of expected outcomes and chances of success if you proceed with your case. They also know about the strategies and tactics of the opposing side and insurance companies. So, they are prepared and can prepare you for the realities of the case.

A car accident attorney knows the legal terms and conditions

Cases involving injury and claims require a lot of paperwork. There are confusing, specialized vocabularies as well as endless forms. An attorney will know the shortcuts and has the staff to help get through the mountains of paperwork, record requests, and communication with all the parties.

He should also have investigative resources

Often, cases need investigation. A lawyer will have contacts or possibly their in-house investigative team to carry out professional investigations that will yield useful evidence in support of your case. Investigators have specialized skill sets to assist with your particular kind of case.

An attorney can make the claim ideal

You might be too close to the situation. Emotions can run high which blinds you to rational, level-headed thinking. An attorney can be a voice of reason to help steer things in a constructive direction untainted by emotion.

They might seek alternative ways of solution

A trial may not be the best pathway to resolution. Attorneys will know of alternatives such as mediation or arbitration. They have the contacts to help make these arrangements and can advise when these methods are appropriate.

An experienced and reputed lawyer is more likely to win the race

If your case is serious enough that you are considering an attorney, you can believe the other side is considering this as well. Whether there is another party to the case or just an insurance company, your attorney will be familiar with the avenues and tactics of both. They will not be tricked by their tactics. In addition, they can call in experts in other areas of the law if needed.

Negotiation is the best settlement

Sometimes the best way to a resolution is a negotiated settlement. Your attorney will be able to help arrange this if appropriate. People who have legal representation typically receive higher settlement amounts while preserving their rights.

Good presentation in the court increases the chances of win

If your case proceeds to a trial, having an attorney is your best way to success. An attorney knows the laws, courtroom procedures, and how to talk to a jury. Although you can represent yourself, your best result will come from having a professional in this situation be the pilot for your case.

Contingency fees agreement is safe for the victim

Like everyone, attorneys have fees for their services. Fortunately, most attorneys will work on contingency. This means that they will not collect their fee from you until you win your case. Often if they are not successful, then you will owe nothing.

Back and Neck Pain from a Car Accident

Read more Car Accident articles: http://j.mp/29Nvdma

Back and neck injuries can be a difficult problem to solve resulting from a car accident. There are a number of suggestions for treatment, and sometimes legal assistance will be needed. Injuries such as these are often not apparent immediately at the accident scene. Due to adrenaline and excitement at the accident scene, these problems can surface hours to days later. Generally, people who receive injuries of this type will recover over several months. Here are a number of steps to address these problems.

At first, rest is recommended

Immediately after the injury, rest is recommended. This is particularly true in the first twenty-four hours after the injury. However, after the first day, prolonged rest can do more harm than good. Too much rest can delay recovery.

Apply heat and cold

Apply a pack of heat or cold to the affected area. This should be applied for up to fifteen minutes for up to six times per day.  A cold pack can be made from using a bag of frozen peas wrapped in a light cloth so that the bag does not directly contact the skin.  For a hot pack, try a hot water bottle.

Try some over the counter pain relievers

Try using over the counter pain relief products containing ibuprofen or acetaminophen. Follow the directions on these products for the proper frequency and dosage. These may help reduce the pain from these injuries.

Perform light neck exercises

After talking to your medical care specialist for advice, you should try some basic neck muscle strengthening exercises. These exercises may include the following kinds of motions: rotating your neck in both directions, move and tilting your head side to side, bend your neck toward your chest, and rolling your shoulders. These exercises could be done to strengthen your muscles pre-injury as a preventative measure.

Wide foam collar limited use is effective

A wide foam collar was once the staple of neck injury treatment. However, more recent research shows that a foam collar can lead to delayed full recovery. The collar means your muscles do not get used as much and, therefore, they do not get exercised, healed, and strengthened. Current medical practice advises people only to use a collar, if needed, during the first week of recovery. Further, people should limit their use of the collar to three hours per day. The one exception to this is wearing a collar while sleeping if it helps you sleep.

Massage can be helpful

Regular massage during recovery can be helpful. The massage should focus on kneading the muscles of the neck and upper back. Be sure to advise the massage practitioner of your health and injuries before your massage begins.  Inappropriately done, massage could lead to more pain and further injury.

Acupuncture punctures pain

Many have had good results from acupuncture. In acupuncture, thin needles are inserted into the skin to lead to less pain and promote healing. Often the acupuncture professional will have knowledge of other areas of Traditional Chinese Medicine (TCM) and might recommend complementary treatments of herbs.

Chiropractic treatment may help

Chiropractic services are manipulation of joints and muscles. Be sure to advise the chiropractor of your injuries and health before beginning treatment. Evidence suggests that the maximum benefit from chiropractic treatment is achieved when it is paired with light exercises and physical therapy.

Prescription drugs can help control pain

People with severe pain may benefit from the short term use of pain relievers or muscle relaxants. These may be administered as a pill or possibly an injection.  These might be used to help you sleep better so that your sleep is restful and healing.  Another purpose is to allow you to complete your exercises or physical therapy without undue pain.

Preserving Your Car Accident Claim

Read more Car Accident articles: http://j.mp/29Nvdma

A car accident is a serious and complicated situation. There are damages to property, vehicles, and the health and welfare of people. Insurance companies are also involved usually from all parties. If you are involved in an accident, you need to take steps to preserve your rights.

Preserve the Evidence

Take steps to get and preserve the evidence of the situation. Take pictures of the vehicles. Contact the police. Get contact information of any witnesses. Make sure to get copies of the police reports and evidence they have of the situation. Keep records of any treatment you receive in connection with the accident.

Get Needed Medical Treatment

It is important to get any treatment needed which is connected with the accident. The treatment should be attended to promptly. Delaying or putting off treatment will be used against you. In the settlement process, getting treatment slowly will be taken as an indication that the injuries were not critical.

Follow the Doctor’s Treatment Orders

When we go for treatment in any normal situation, we might not follow the doctor’s instructions completely. Situations at work and with family might lead us to choose something over the proper care. However, in this situation, when you are making a claim for an injury, it is imperative that you follow the doctor’s orders.

Tell Your Lawyer about Past Accidents

If you have had any past traffic accidents, be sure to tell your lawyer of this as soon as possible. Insurance companies may try to use past accident situations to claim that you have a condition that makes you predisposed to accidents. Your lawyer can defend against these claims in a forthright manner, but only if you reveal the situations from the beginning.

Signing a Blanket Release

Do not sign a release for the insurance companies to get you entire medical history. The insurance companies can then hunt through your records for any issue since your birth to construe as a pre-existing condition that predates the accident. It is strongly encouraged to speak with your lawyer before signing any release.

Do Not Misrepresent Your Injuries

Insurance companies are known to hire investigators to monitor and even video tape victim’s activities. This can be used to show that you, the victim, have exaggerated the seriousness of your injuries or the effects of your injuries. There is nothing legally to prevent this kind of surveillance. The investigator’s report and video can be used to destroy your credibility. Be honest about your true situation.

Do Not Make a Statement

Often, insurance companies will contact victims for a statement very soon after an accident. Do not make a statement to them. The insurance company’s goal is to get you to misspeak in a way that will damage your claim. [* It is strongly encouraged that you consult your lawyer before making any statement to an insurance company.*]

Avoid Social Media

Postings on social media become a matter of public record. Victim’s postings of photographs, comments, and details about their life will be used as evidence against the victim as the case progresses. These postings may directly be about the accident or just everyday life. [* Either way, you, the victim, should avoid providing information on social media which could be used against you in unforeseen ways.*]

Keep Your Employer Informed

After an accident, keep your employer informed of your situation and medical condition. Follow your employer’s instructions for protecting yourself in your job responsibilities. In other words, make sure your work environment or duties do not lead to further injury.

Car accidents can be a serious and a problematic situation for the victim. Damage to self and property and the vehicle can cause a lot of trouble and tension. It is important to make sure that the victim gets prompt treatment without getting into financial troubles of medical expenses, car repairs and insurance. If you get into a car accident you should avoid doing certain mistakes.

Do Not Make Statements at the Car Accident Scene

All insurance companies would try avoiding making payments at such an event. The law states that any statement made by the victim can be used against him during legal proceedings. Get Prompt Medical Treatment

It is important that the victim gets treatment that is connected with the accident. The treatment should be promptly attended. Getting proper medical treatment will help in knowing the medical condition suffered by the victim during the accident. Not seeking prompt medical attention will worsen the condition of the victim and the insurance company will use this against you saying that you were not severely injured. This can also reduce the value of the case.

Preserving the Evidence

Take enough steps to procure and preserve the evidence of the accident. Take pictures of the vehicle that met with the accident. Take contact information of any witnesses. Also make sure you collect copies of the police reports and all the evidence of the accident. Keep records of the treatment undergone in relation to the accident.

Be Consistent in Attending Treatment

You should never delay or postpone receiving medical treatment as this can work against you. Insurance companies will feel that the reason you put off the treatment was because you were not badly injured during the accident and will pay you less. During settlement process, seeking treatment slowly will be given a consideration that the injuries were not critical because getting well from a traumatic injury requires constant and consistent medical attention.

Be Truthful About Previous Injuries and Claims

The insurance company can make a claim that the accident was due to negligent driving. If the accident occurred due to previous injuries or medical conditions, it is important to mention this. Pre-existing conditions will not come in the way of your claim. Failure to mention past injuries and medical condition can diminish the strength of your case. This is more so if the part of the body injured in the current accident was the part with an existing medical condition.

Seek Legal Advice Promptly

Seeking legal advice from good and reputed lawyers is very important. Your lawyer can give you advice on what to say and how to deal with the situation and also tackle the claims made by the insurance company tactfully. Your lawyer will make sure that every damage that you incur is well accounted for and will help in making negotiations in medical fees thereby maximizing the money you can make out the case.

Do Not Post on Social Sites

Postings done on social sites like Facebook and Twitter can become public record. Do not post pictures, comments or videos on these social sites as they can be used against you. Even if the photos are not directly related to the accident, the insurance company may use this information and it can be used against you in unforeseen ways.

Inform Your Employer

After the accident, it is advisable to keep your employer informed about the current situation and the medical treatment that you are undergoing. Employer’s advice and instructions should be carefully followed as this can protect you in your responsibilities towards the job. Make sure that your work ambience will not cause any further injury or reduce the value of the case.
